Terms of Service

1. Acceptance of Terms

By accessing or using SkyFSBookings ("the Service"), operated by General Aviation Solutions LLC ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

SkyFSBookings is a web-based software platform for flight school management, including scheduling, pilot currency tracking, fleet management, and related aviation services. The Service is provided on a subscription basis. We do not guarantee 100% uptime or uninterrupted access to the Service. Scheduled and unscheduled maintenance windows may result in temporary unavailability. We are not liable for lost revenue, missed bookings, or other damages resulting from Service downtime or outages.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3a. Age Requirements

The Service is not for children under 13. If you are an administrator creating accounts or entering information for students, members, or instructors, you represent and warrant that you will not create an account for, and will not enter personal information about, any individual under the age of 13. This is an absolute restriction: parental consent does not permit it, and we do not offer a mechanism to obtain that consent.

There is no upper or lower age requirement beyond that. Flight training is lawfully undertaken by minors — a student may solo at 16 — and members aged 13 and over may hold accounts, subject to their school agreeing to these Terms on their behalf. Administrators are responsible for the accounts they create and for the conduct of the people they invite.

If we learn that an account or record relates to an individual under 13, we will delete it. Tell us at support@skyfsbookings.com if you believe one does.

4. Subscription, Payment, and Refunds

Paid plans are available on monthly or annual billing cycles and are billed in advance. Payments are processed by Paddle, which acts as the merchant of record for all purchases; Paddle's buyer terms and privacy policy govern the payment transaction, and charges appear on your statement under Paddle's name.

Free trial and automatic renewal. Paid plans include a 7-day free trial that begins at checkout. A payment method is required to start the trial. Unless you cancel before the trial ends, your subscription will automatically begin and your payment method will be charged the plan price then in effect. Subscriptions renew automatically at the end of each billing period — monthly for monthly plans, annually for annual plans — at the then-current price, until cancelled. For annual plans, we will send a renewal reminder to your account email between 15 and 45 days before each renewal.

Cancelling. You may cancel at any time through the billing portal in your account settings, in as few steps as it took to subscribe. Cancellation takes effect at the end of the current billing period; you keep access until then.

Refunds. We offer a 30-day refund policy: if you are not satisfied, you may request a full refund within 30 days of your initial purchase or most recent renewal. Requests can be submitted through the billing portal or by contacting us at support@skyfsbookings.com. Refunds are issued by Paddle.

Price changes. We may change pricing with 30 days' written notice to your account email. Changes take effect at your next renewal.

The Free plan requires no payment method, does not expire, and never converts to a paid plan automatically.

5. Acceptable Use

You agree not to misuse the Service. This includes but is not limited to: attempting to gain unauthorized access to other accounts or systems, interfering with the operation of the Service, using the Service for any unlawful purpose, or transmitting any malicious code.

6. Data Ownership

You retain ownership of all data you enter into the Service. We do not claim any intellectual property rights over your content. Administrators may export their organization's roster, bookings, and maintenance costs at any time using the built-in CSV export features. Upon account termination, we will retain your data for 30 days before permanent deletion, unless otherwise required by law. During that 30-day window you may reactivate the account or request an export; after it closes the data cannot be recovered.

6a. Your Data and Our Role as Service Provider

Roles. As between you and us, you are the controller (or "business," as that term is used in applicable US state privacy laws) of the personal information you and your users enter into the Service, and we act solely as your processor and service provider. You are responsible for providing any notices and obtaining any consents required for you to enter that information into the Service and for us to process it on your behalf.

Our commitments. We will: (a) process personal information only on your documented instructions, which include these Terms and your and your users' use of the Service; (b) not retain, use, or disclose personal information for any purpose other than performing the Service, and specifically not sell it, share it for cross-context behavioral advertising, or use it outside our direct business relationship with you; (c) not combine it with personal information received from other sources, except as permitted for a service provider under applicable law; (d) require personnel with access to it to be bound by confidentiality obligations; (e) implement and maintain reasonable technical and organizational security measures appropriate to the risk; and (f) assist you, at your reasonable request and expense, in responding to verified requests from individuals to access, correct, delete, or obtain a copy of their personal information.

Subprocessors. We use the service providers identified in our Privacy Policy to help deliver the Service. We remain responsible for their performance of these obligations. We will update the Privacy Policy before engaging a new subprocessor that processes your users' personal information, and you may object by terminating your subscription.

Deletion and return. On termination, we will delete or return personal information as described in Section 6 and in our Privacy Policy, except where retention is required by law.

Audit. On reasonable written notice, and no more than once in any twelve-month period, you may request a written summary of the security measures we maintain. We will respond within thirty days.

Security incidents. We will notify you without undue delay, and in any event within five (5) business days, after confirming a breach of security leading to the accidental or unlawful destruction, loss, alteration, or unauthorized disclosure of or access to personal information you have entered into the Service. We will provide the information reasonably available to us to help you meet your own notification obligations, and will keep you updated as we learn more. This period is an outer limit, not a target — where a breach is likely to require you to notify individuals or a regulator, we will tell you as soon as we can confirm it.

7. Disclaimer

SkyFSBookings is a scheduling and management tool only. It is NOT a replacement for FAA-required documentation, official logbooks, or regulatory compliance systems. The final responsibility for ensuring a pilot is current and an aircraft is airworthy lies solely with the Pilot in Command (PIC) and the flight school operator. All currency tracking information is provided for convenience only and must be independently verified against authoritative sources. We are not responsible for ensuring regulatory compliance of any flight school, instructor, or pilot using the Service.

7a. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, GENERAL AVIATION SOLUTIONS LLC DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY CURRENCY, MAINTENANCE, OR SCHEDULING INFORMATION IT DISPLAYS IS ACCURATE OR COMPLETE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.

8. Limitation of Liability

To the maximum extent permitted by law, General Aviation Solutions LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

9. Third-Party Services

The Service may integrate with or depend on third-party services, including but not limited to payment processors (e.g., Paddle, Stripe), email delivery providers, and push notification services. We are not responsible for the availability, accuracy, security, or performance of any third-party service. Any failure, error, or data loss caused by a third-party provider is outside our control, and we disclaim all liability arising from such failures. Your use of third-party services is governed by those providers' own terms and privacy policies.

10. Indemnification

You agree to indemnify, defend, and hold harmless General Aviation Solutions LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation, including FAA regulations; or (d) any claim by a third party arising from your misuse of the Service or your failure to ensure pilot currency or aircraft airworthiness.

11. Termination

Either party may terminate this agreement at any time. You may cancel your subscription through the billing portal; cancellation takes effect at the end of the billing period you have already paid for, and you keep access until then. Cancelling a subscription does not by itself delete your data — your organization moves to the Free plan and its data remains available. To have your organization and its data destroyed, request deletion from your account settings or by contacting us; deletion is subject to the 30-day retention window described in Section 6, during which you may reactivate or request an export. After that window the data is permanently deleted and cannot be recovered. We may suspend or terminate your access if you violate these terms, in which case your right to use the Service ceases immediately. Termination does not entitle you to a refund except as provided in Section 4.

12. Governing Law

These Terms shall be governed by the laws of the State of Ohio, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in the State of Ohio.

13. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance of the updated terms.
